First Four TLDs Pass Pre-Delegation Testing

The first four new Top Level Domains (TLDs) have passed pre-delegation testing. Historically, it has taken most companies about 9 months after the Registry Agreement is signed before domain names go on sale to the general public. The four TLDs signed Registry agreements in April 2013. These TLDs may begin to sell domain names to the public as early as December 2013 or January 2014. more

Trademarks for TLDs

The United States Patent and Trademark Office (USPTO) has recently circulated proposed examination guidelines to allow the USPTO to begin providing Trademark Protection for Top Level Domains (TLDs). This is an important new development. TLDs today are currently ineligible for Trademark protection on the basis that they do not constitute a source-identifying mark. The USPTO is currently in the process of rectifying this situation by extending Trademark protection to Registry Service providers and has released its proposed examination procedures for that purpose. However, there are some very concerning elements to their proposed examination guidelines. more

First Four Registry Agreements Signed for New TLDs

The first four new Top Level Domains (TLDs) have signed contracts with ICANN, known as Registry Agreements, to allow the applicants to operate new TLDs on the Internet. This is a historic event and marks the first of many new Registry Agreements which will be signed over the coming months as prospective new TLD operators complete the Initial Evaluation phase, pre-delegation testing, and finally sign Registry agreements. more

An Update on the Closed Generics Debate

ICANN is currently seeking public comment on the subject of "closed generic" Top Level Domain (TLD) applications. A "Closed Generic" is a TLD that is a generic term, but domains within that TLD will not be sold to the public. There are those who object to generic terms such as .book being operated as closed registries, which means that domain names within the .book Top Level Domain as proposed by Amazon would not be sold to the public, but instead, Amazon.com would own and operate all domain names within the .Book Top Level Domain. more

18 TLD Applications Withdrawn to Date

A total of eighteen applications for new Top Level Domains (TLDs) have been withdrawn by the applicants. Of the 18 applications that have been withdrawn so far, just five were applications for generic terms, and the remaining thirteen withdrawn applications were for branded Top Level Domains. In the case of the branded TLDs, it may be that the applicant originally only filed what has been called a "defensive application", meaning that the company applied for the Top Level Domain to prevent its falling in the hands of a competitor. more

The Case for Trademark Protection for Top Level Domains

The United States Patent and Trademark Office currently does not provide Trademark protection services for the Top Level Domain industry, an industry which generates almost $1 Billion in revenues annually in the United States. The Top Level Domain industry is the only legal business class in the United States that is denied constitutionally guaranteed intellectual property protections... The lack of Trademark Protection for the Top Level Domain industry has greatly increased the amount of uncertainty associated with the ICANN Application Process for new Top Level Domains. more
