Why does all of the discussion around potential options for WHOIS in the era of the EU's GDPR (General Data Protection Regulation) feel like déjà vu? Is it because issues around WHOIS never really go away, and become a hot topic every few years? Is it because no one is really happy with the current system? Privacy advocates would be delighted to do away with it altogether, while business and Intellectual Property professionals press for improvements to accuracy and availability, which I fully support. more
The Registration Operations Workshop (ROW) was conceived as an informal industry conference that would provide a forum for discussion of the technical aspects of registration operations in the domain name system. The 6th ROW will be held in Madrid, on Friday May 12th 2017 in the afternoon, immediately after the GDD Industry Summit and prior to ICANN DNS Symposium and OARC 26, using the same venue as all above-mentioned events. more
The non-contracted parties of the ICANN community met in Reykjavík last week for their annual intersessional meeting, where at the top of the agenda were calls for more transparency, operational consistency, and procedural fairness in how ICANN ensures contractual compliance. Following a very successful series of workshops held during IETF meetings, the next Registration Operations Workshop (ROW) is now being held during the upcoming ICANN meeting in Hyderabad, India. While the previous workshops were of advanced topics attended by industry experts, the current one will be more of a tutorial and is open to all interested parties. more

As a longtime member of ICANN's Intellectual Property Constituency (IPC), I'm impressed by the important work that this group does on behalf of trademark owners worldwide (as I've written before). While some die-hard IPC members spend countless (and, often, thankless) hours working virtually and in-person (at ICANN's global meetings) for the constituency, I find it very educational and worthwhile to participate on an ad-hoc basis. more
As you may know, ICANN holds three public meetings every year. The most recent one, ICANN 54, was held in Dublin... So the next ICANN meeting is being held in Marrakech, Morocco starting Saturday, March 5th through March the 10th. Up until now all three meetings were the same length and had the same basic structure. However, from this year onwards, that'll change. How that will play out in reality, however, is anyone's best guess. more
As promised, 2016 is off to a busy start at ICANN, with important discussions about Whois/Registration Directory Services, subsequent rounds of the New gTLD Program and internet governance already underway, and more to come. Brand owner concerns will be front and center in the coming months, as community stakeholders set priorities and begin discussions of key challenges and desired results. more

In 1905, philosopher George Santayana famously noted, "Those who cannot remember the past are condemned to repeat it." When past attempts to resolve a challenge have failed, it makes sense to consider different approaches even if they seem controversial or otherwise at odds with maintaining the status quo. Such is the case with the opportunity to make real progress in addressing the many functional issues associated with WHOIS. We need to think differently. more

In June, MarkMonitor joined our colleagues once again at the Internet Corporation of Assigned Names and Numbers (ICANN) 53rd public meeting in Buenos Aires, Argentina. Several high-profile and contentious issues were on the agenda, many of which have significant impact on the interests of intellectual property and brand owners. Among these are the ongoing ICANN Accountability issues and the impending departure of ICANN CEO Fadi Chehadé; registrant information (Whois) transparency, accuracy and accessibility; and the timing of the next round of new gTLD applications/delegation. more
For the past two years a diverse group of stakeholders from the ICANN community, including myself, has been working hard to come to a consensus on a set of recommendations related to development and implementation of an ICANN accreditation program for privacy & proxy service providers. The result of this effort will replace the interim specification defined in the 2013 Registrar Accreditation Agreement (RAA) that is due to expire at the end of 2016. more
ICANN comment periods on policy proposals don't normally garner much attention. In the case of the current comment period on proxy/privacy services, however, things are very different. To date several thousand comments have been filed, while the topic of the policy proposals has received media attention across hundreds of outlets. more
